These Terms of Service ("Terms") govern your use of kadenawallet.io (the "Site") and the Kadena Wallet desktop application (the "Wallet"), both operated by KADENA WALLET LLC (the "Company," "we," "us"). By using the Site or the Wallet, you agree to these Terms. If you do not agree, do not use the Site or the Wallet.
These Terms include important disclaimers and limitations of liability, particularly regarding self-custody responsibility and the absence of investment advice.
1. About the Company
KADENA WALLET LLC, a Florida limited liability company, registered office at 7752 NW 72nd Avenue, Medley, FL 33166, USA.
2. The Wallet — open-source software
The Wallet is open-source software released under the MIT License. The full text of the MIT License is included in the Wallet's source distribution and is available alongside the source code repository.
The MIT License is a permissive license. It allows anyone to use, modify, and distribute the Wallet, including for commercial purposes, with attribution and without warranty. Your use of the Wallet under the MIT License is governed by the license itself; these Terms supplement (but do not override) the MIT License with respect to your use of the Site and any optional services we provide.
3. Self-custody and responsibility
The Wallet is a self-custody, non-custodial cryptocurrency wallet. This means:
You hold your private keys. The Wallet generates and stores private keys locally on your device. We do not have access to your private keys and we cannot transmit them to ourselves or to anyone else.
We cannot access your funds. Because we do not have your private keys, we cannot access, freeze, transfer, or otherwise control any cryptocurrency held in your Wallet.
You are responsible for your recovery phrase. When you create a Wallet, you receive a recovery phrase (typically 12 words). This phrase is the only way to restore access to your Wallet on a different device. If you lose your recovery phrase and lose access to your device, your funds are not recoverable. We have no ability to recover lost recovery phrases. No third-party service can either; anyone claiming otherwise is running a scam.
You are responsible for your transactions. Cryptocurrency transactions are irreversible once confirmed on-chain. We cannot reverse transactions, recover funds sent to wrong addresses, or undo transactions you did not intend to make.
You are responsible for your operational security. This includes: protecting your device from malware, verifying the authenticity of websites and software you interact with, safeguarding your recovery phrase from disclosure, and exercising appropriate caution when interacting with smart contracts and decentralized applications.
For more on recovery scenarios and what is and is not possible see Wallet recovery.
4. No warranties
THE SITE AND THE WALLET ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE OR THE WALLET WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT WARRANT THAT THE WALLET WILL OPERATE WITHOUT BUGS, THAT IT WILL BE COMPATIBLE WITH ANY PARTICULAR HARDWARE OR OPERATING SYSTEM CONFIGURATION, THAT IT WILL CONTINUE TO BE COMPATIBLE WITH FUTURE VERSIONS OF THE KADENA CHAIN, OR THAT IT WILL BE FREE FROM SECURITY VULNERABILITIES.
We have completed an independent third-party security audit; the full report is pending public release. The audit's existence does not constitute a warranty against future vulnerabilities or a guarantee of correctness; it is a snapshot of code review at a specific point in time.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF CRYPTOCURRENCY, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR THE WALLET, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THE WALLET WILL NOT EXCEED $100 USD OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
6. No investment advice
NOTHING ON THE SITE OR IN THE WALLET CONSTITUTES INVESTMENT ADVICE, FINANCIAL ADVICE, TRADING ADVICE, OR ANY OTHER FORM OF ADVICE.
The information we publish about Kadena (KDA), including price data, exchange status, mining profitability calculations, and ecosystem developments, is provided for informational purposes only. We do not give buy, sell, or hold recommendations. We do not provide price predictions; see Kadena price prediction for our position on this.
You are solely responsible for your investment decisions. Cryptocurrency investments involve substantial risk including total loss of capital. Past performance is not indicative of future results.
7. Trademarks and product naming
References to third-party names on the Site (including KADENA®, CHAINWEAVER®, PACTLANG, and KADENA KURO) are descriptive references to publicly known projects, not assertions of trademark ownership. The Wallet is named "Kadena Wallet" because it is a wallet for the Kadena chain — a descriptive product name.
8. Third-party services
The Wallet may interact with third-party services including but not limited to: cryptocurrency exchanges (MEXC, Gate.io, others), decentralized exchanges (eckoDEX, KDSwap), mining pools, hardware wallet manufacturers (Ledger), and Kadena Chainweb RPC providers.
We do not control these third-party services. Your use of these services is governed by their own terms and policies. We are not responsible for actions, omissions, or content of third-party services.
9. Acceptable use
You agree not to use the Site or the Wallet to:
- Violate any applicable law or regulation
- Engage in any activity that could harm or disrupt the Site, the Wallet, or other users
- Attempt to gain unauthorized access to any part of our systems
- Conduct or facilitate money laundering, financing of terrorism, sanctions evasion, or other prohibited activities
- Misrepresent your identity or affiliation
- Impersonate KADENA WALLET LLC or our representatives
- Engage in fraudulent, deceptive, or abusive practices
Violation of these terms may result in suspension or termination of your access to optional services we provide.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted at the top of this page for a reasonable period. Your continued use of the Site or the Wallet after changes constitutes acceptance of the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site or the Wallet shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, USA.
For users in jurisdictions with consumer-protection laws that supersede contractual choice of law: those laws apply notwithstanding the above to the extent required.
12. Severability
If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
13. Entire agreement
These Terms, together with the Privacy Policy and the MIT License governing the Wallet's open-source distribution, constitute the entire agreement between you and KADENA WALLET LLC regarding the Site and the Wallet, and supersede any prior agreements or representations on the subject matter.
